Care home boss guilty of misconduct

A CARE home manager has been found guilty of misconduct but not unfit to practise as a nurse by a panel looking at his conduct towards a 99-year-old patient with Alzheimer's.

The Nursing and Midwifery Council (NMC) conduct and competence panel praised Charles Jones's "obvious concern" for the elderly resident.

Jones was accused of carrying out an inappropriate rectal examination on the resident of Anbridge Care Home, in Oldham, Greater Manchester, where he is manager and co-owner.

It was alleged he carried out the process – to check for constipation – without getting the man's consent and without following the correct procedure.

Jones, 57, from Mirfield, West Yorkshire, told the panel he spoke to the man, known as resident A during the hearing, before starting the examination and that the patient had indicated consent by nodding.

The ruling said the accusation that Jones had not obtained consent had not been proved.

The panel said his failure to follow procedure was "inappropriate" and amounted to misconduct as it did not meet professional standards. But it ruled his fitness to practise was not impaired, describing the incident as an isolated lapse.
