The court heard the couple have a child together and were in a relationship at the time of the incident in November, 2014.

Smith locked the front door and refused to let her leave the property after punching and slapping her.

He then phoned for a takeaway and attacked her again as they ate it. Smith picked up a fork and stabbed the victim in the feet with it before throwing the Pot Noodle over her. He then ripped up a passport which he believed belonged to her but in fact belonged to the victim’s sister

She was eventually allowed to leave and told her mother about the attack. She suffered bruising to her stomach, feet and arms.

Smith was arrested and released on bail but attacked the victim again three months later, on Valentine’s Day last year.

She needed hospital treatment after Smith caused injuries to her left hand when he threw punches at her.

Magistrates jailed Smith for 16 weeks over the second attack but failed to deal with the original offence. Smith, of Graham View, Burley pleaded guilty to assault occasioning actual bodily harm and criminal damage over the November 2014 incident. He was given a ten month sentence, suspended for two years, and ordered to do 120 hours unpaid work.

The Recorder of Leeds, Judge Peter Collier, QC, said: “I am going to make you do some work within the community to see if you can grow up properly.”
