Jail for brothers in ear-bite fight

TWO brothers were each jailed for four years yesterday after a court heard they left a man with part of his ear bitten off after a fight outside a birthday party.

Sentencing Scott and Daniel Mitchell at Leeds Crown Court, Recorder Dean Kershaw said the incident was “unpleasant and brutal to say the least”.

“It involved a man having one third of his ear bitten off who is now permanently disfigured as a result of the actions you took part in.

“Whether it’s one of you two, or a third person that actually bit it off, you accept responsibility and are to be treated in the same way.”

Scott Mitchell, 30 and Daniel Mitchell, 28, both of Sunshine Court, Woodside, Bradford, each admitted inflicting grievous bodily harm to Gary Madeley. Both are currently serving sentences for burglary offences.

A third man, David Hargreaves, 27, of Hare Park Avenue, Liversedge, who admitted affray in the same incident on June 27, 2009, was given an 18-month community order with 100 hours unpaid work.

Jonathan Devlin, prosecuting, said it was not possible to prove who was responsible for the ear bite.

Andrew Stranex, for Scott Mitchell, said he accepted being part of an unlawful assault in which the biting occurred but was not responsible for it.

Anne-Marie Hutton, for David Mitchell, said drink taken at the party had affected his actions which he regretted in the “cold light of day”.

He too denied the biting but accepted joint involvement.
