M-way driver put foot out of window at 70

A MAN caught driving with his foot out of his car window while travelling at 70mph on a motorway has avoided a jail term.

James Nunns was struck by cramp in his foot as he returned home from work last September and carried out the dangerous manoeuvre in the outside lane during rush-hour traffic.

Instead of pulling over onto the motorway hard shoulder, Nunns – a painter – decided to flex his foot out of the driver's window of his Ford Escort.

He was caught after stunned police officers spotted him while patrolling in a marked patrol car.

Nunns, 27, who admitted dangerous driving at Doncaster Crown Court yesterday had also taken his shoe off before hanging his foot out of the window.

Prosecutor Christopher Tonge said: "He appeared to be sat very low in his seat as though he was reclining backwards. The officers saw part of his right leg and foot sticking out of the driver's window.

"As he went along the brake lights of his vehicle came on. He clearly touched the controls with his left foot because his right foot was still through the driver's window."

Richard Thyne, defending, said Nunns acknowledged he had been "stupid and irresponsible".

He said his girlfriend of four years was threatening to leave him, his parents were on the verge of disowning him and if he was jailed he would lose his job.

"For a few moments of foolishness and stupidity he has put relationships with those who are nearest and dearest to him in severe jeopardy," he said.

Recorder Peter Babb told him: "What you did on that particular Tuesday afternoon beggars belief. I don't think anybody in this courtroom can see why you would do that.

"Fortunately there was no serious injury or death but that is more than a distinct possibility for people who drive with one foot out of the window."

Nunns, of Rossington, Doncaster was given 200 hours of unpaid work, banned from driving for two years and ordered to complete a responsible road users course.
