Parents threaten to sue after girl who climbed on luggage rack falls out of bus

A BUS company has been threatened with legal action by the family of a schoolgirl who climbed into a luggage rack and fell out of a window.

The 12-year-old toppled out as the bus approached a roundabout in Hull on the way to Cottingham High School.

Ellie Rose Travel Ltd said in the lead up to the accident, a group of girls had been banging on the window, which is designed so it can be pushed out in case of emergency. The whole incident was recorded on CCTV.

According to a letter from solicitors, the youngster, who fell out alongside another girl, suffered minor injuries and has experienced anxiety.

Jim Houghton, owner of Hull-based Ellie Rose Travel Ltd, said the female driver was "absolutely distraught" after the incident. The parents of the other girl didn't want to take the matter further.

"They chose to stand in the luggage rack," he said. "They were asked several times by the driver to take a seat, which there were plenty of. They refused and at that point there isn't anything she can do — she can't physically make them sit.

"If she stops the bus and says we will sit here till you sit down the kids love it and by then the school is on the phone."

The vehicle was immediately examined by the Vehicle and Operator Services Agency and found to be without flaws.
