Plan to extend curry takeaway hours opposed

AN application to extend the opening hours of a suburban curry takeaway is opposed by planning officers because of worries over an increase in noise.

The owners of City Spice, on Mansfield Road, Intake, Sheffield, have approached licensing bosses to extend their business hours from 11.30pm until 1am every day.

They argue the shop is already an "established takeaway" and an

extension in hours would not result in further disturbance to

neighbours in surrounding streets.

According to their application, a notice at the premises already asks customers to "depart in a manner so as not to disturb local residents", a practice which will continue.

The shop's owners also say their staff are "vigilant of crime" and take steps to ensure that any litter which is associated with the business is cleaned up promptly.

But Sheffield Council's head of planning, Phil Abbott, has lodged a formal objection to the application, citing concerns over the

takeaway's "proximity to dwellings".

In a report to be considered by members of the authority's licensing committee next week, Mr Abbott raises a number of concerns about the impact on the community.

He says: "I have concerns that there is a potential for noise nuisance to occur both from the premises opening until 1am and from patrons leaving the premises.

"Customers would cause noise while arriving at the site, while waiting for orders, while consuming food immediately outisde and while departing to respective residences.

"Some customers would also visit the venue by car and this would create some substantial noise in relation to vehicle movements, starting of engines and doors closing.

"Similar outcomes would occur in relation to delivery vehicles which would operate in connection to the operation of the business, which would also involve food preparation."

Mr Abbott advises licensing committee members that an extension of hours would be a "breach of planning approval" and could result in official enforcement action by officers.

The committee will decide on the application at a meeting on Monday.
