Father is jailed after breaching restraining order for third time

A JUDGE jailed a man for two years after hearing he breached a restraining order to stay away from his ex-girlfriend within hours of his last court appearance for the same behaviour.

Sentencing Michael Charles at Leeds Crown Court yesterday Judge Paul Hoffman said it was his third breach of the order and a pre-sentence report indicated “you won’t take no for an answer”.

He said Charles had already served two short prison sentences and history showed within hours and no more than a day of his release, he was back banging on the door of his former girlfriend’s home causing her fear.

“You showed contempt for her and plainly showed contempt for the court orders.”

Charles, 30 of Dewsbury Road, Leeds admitted breaching the restraining order in February.

Charlotte Worsley prosecuting said on June 7 last year Leeds Magistrates imposed a community order and the restraining order after Charles was convicted of smashing a window at the home of Tracey Aveyard.

He was then arrested after he twice went to the house on June 8 and 10 banging on the door and was jailed for five months for the original damage and breaches.

On his release he once more returned to the property that night banging on the door and saying he would kill himself if she did not speak to him. Miss Worsley said he was there until police arrested him and he was then remanded in custody.

In February he was jailed for six months for that breach and the restraining order, which barred him from contacting Ms Aveyard was extended from two years to three years.

However, because of time served on remand, he was released later the same day and by 4am was back at his former girlfriend’s home in Oaklands Drive, Leeds knocking on the door. He was again arrested.

Miss Worsley said Tracey Aveyard was concerned for the safety of herself and her children fearing he might even start a fire at the property.

Tim Jacobs for Charles said no violence or threats were involved in the visits. The couple had a child and he wanted to see his son.

“He understands he must learn to obey this order otherwise the sentences will get longer.”

The judge ordered it recorded that Charles had to be restrained from speaking to Ms Aveyard in the public gallery as he was taken from the dock.
