Jailed for attack on love rival with ashtray

Eric Brummitt flew into a rage after bursting into his ex-partner’s home and throwing the object at the victim’s head.

The 37-year-old then caused damage to his rival’s car after the attack.

Brummitt, of Dunlin Court, Belle Isle, Leeds, was jailed for 14 months yesterday after he pleaded guilty to three offences of assault occasioning actual bodily harm and two of criminal damage.

Leeds Crown Court heard Brummitt and his wife have three children but were estranged at the time of the incident, which took place in the early hours of September 30 last year.

Brummitt burst into her home in Leeds at 3.30am as she was watching television in the sitting room with her new partner. He shouted at the victim and threw punches. One of their children came downstairs during the disturbance.

The court heard Brummitt then picked up a cut glass ashtray and threw it at the victim from a few feet away. It struck him on the head, causing a wound which had to be stapled when he was taken to hospital.

Brummitt then went outside and punched the window of the victim’s car several times and kicked the wing mirror.

He then got into his own car and drove off. As he did so he threatened to bomb the victim’s car and bite his nose off if he contacted the police.

Brummitt returned to the house later that day, around 6.50pm, and banged on the window. He also made demands for £3,000 before throwing a large rock through the victim’s car window. The court heard Brummitt caused around £500.

Police were called and Brummitt was arrested but refused to answer any questions.The court heard Brummitt worked as a roofer, earning around £300 per week, was dedicated to his children and pleaded guilty to the offences at an early opportunity.

Judge Christopher Batty said the offences were so serious that only an immediate prison sentence was appropriate.

He said: “The fact is that on the night in question you let yourself into your ex-wife’s home when you were not invited and you immediately set about her new partner and you repeatedly punched. In the presence of your 12-year-old daughter you through a cut glass ashtray at his head.

“It must have been a deeply unpleasant experience for him and indeed your daughter.”
