Pharmacy wins legal fight over planning ‘flaws’

A pharmacy which used the Human Rights Act to try to thwart the opening of a rival on its patch has won a costs payout from Leeds City Council after the authority admitted “flaws” in its decision-making process.

Planning chiefs are this week due to reconsider an application for a major extension to Manor Park GP surgery in Bramley.

The proposals include a new pharmacy with extended opening hours within the building.

Councillors approved an initial application in October last year. However Lloyds Pharmacy – which already runs its own service in the same complex – submitted an objection. This was despite the firm already having been approached to operate the new pharmacy itself.

After consulting its lawyers, Leeds City Council conceded there were “flaws” in its officers’ original report.
